3. General conditions of use (GCU) of the Site and the services offered
Use of the Site implies full and complete acceptance of the general conditions of use described below. These conditions of use may be modified or supplemented at any time, users of the Site are therefore invited to consult them regularly. EvidenceB strives to update the Site regularly.
The Site is normally accessible to users at all times. An interruption for technical maintenance reasons may however be decided by EvidenceB, which will then endeavour to communicate to users in advance the dates and times of the intervention. Access to the site is free unless otherwise stated on certain parts where applicable. However, it is up to the user to have the means to access this Site, whether for the equipment and the connection (ISP) for example.
The user of the Site agrees to access the Site using recent equipment, protected by an updated anti-virus and with an updated latest generation browser. The user also agrees not to damage, disable, disrupt the integrity of the Site or the data contained therein, or not to overload the Site, or not to prevent any third party from using it. If the user is a minor, he or she must be at least fifteen years old and in all cases, he or she remains under the responsibility of the holder of parental authority who must have authorized him or her to use the Site. Access to certain parts of the Site may be subject to specific usage rights, and the user agrees to respect them.

The purpose of the Site is to provide information concerning all of the activities of the company EvidenceB.

5. Limitations of liability of EvidenceB
EvidenceB undertakes to make its best efforts to ensure that users have access to the Site at all times. However, it cannot be held responsible in the event of unavailability of the Site, for any reason whatsoever.
Furthermore, EvidenceB reserves the right, at any time, to modify and/or interrupt, temporarily or permanently, all or part of the Site (see also below); in particular, EvidenceB may modify the Site and its content at any time, in particular the services described therein.
The information provided on the Site by EvidenceB is for information purposes only and is subject to change. Also, EvidenceB cannot guarantee the accuracy, completeness and/or timeliness of the information published on the Site, whether by its own actions or by third-party partners who provide it with this information.
EvidenceB may also not be held liable for any direct or indirect consequences that may arise from errors in entering contact details or any other incomplete or erroneous information transmitted by the user via the Site. EvidenceB may not be held liable for any direct or indirect damage caused to the user’s equipment when accessing or using the Site, and resulting either from the use of equipment that does not meet the specifications indicated in these T&Cs, or from the appearance of a bug or incompatibility. EvidenceB may also not be held liable for indirect damage (such as loss of market or loss of opportunity) resulting from the use of the Site. EvidenceB cannot be held responsible for the consequences, direct or indirect, which may arise from errors in entering contact details by the user or from any other incomplete or erroneous information transmitted by the user via the Site.
Interruption of the site for maintenance or improvement
EvidenceB undertakes to do everything possible to ensure the proper functioning of the Site and its accessibility (obligation of means concerning the continuity of access to the Service). The Site may be temporarily inaccessible in the event of an update for a technical development, maintenance, update and/or in the event of an emergency. More generally, the interruption of the site whatever the cause, duration or frequency, will not engage the liability of EvidenceB and will not entitle the user to any compensation.
Force majeure
Neither party shall be liable to the other party for a delay in performance or non-performance due to the occurrence of an event beyond the control of the parties which could not reasonably have been foreseen at the time of acceptance of the T&Cs and the effects of which cannot be avoided by appropriate measures. The case of force majeure suspends the obligations of the party concerned for the time during which the force majeure will apply if this event is temporary. Nevertheless, the parties will endeavour to minimise its consequences as far as possible. Failing this, if the impediment is permanent, the parties will be released from their obligations under the conditions provided for in Articles 1351 and 1351-1 of the Civil Code.
6. Intellectual property and counterfeiting
The elements contained on this Site, such as brands, texts, presentations, illustrations, photographs, databases, etc. are protected by intellectual property rights, including those arising from international legislation in force.
Also, any reproduction, modification, adaptation or representation, even partial, of these elements, for purposes other than private use, on any medium whatsoever and without the express prior written authorization of EvidenceB is prohibited and constitutes an infringement, likely to engage the civil and/or criminal liability of its author.
7. Protection of personal data
EvidenceB is committed to a continuous process of compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 applicable from 25 May 2018 (GDPR) and Law No. 78-17 of 6 January 1978 relating to information technology, files and freedoms, as amended (known as the “Information Technology and Freedoms” Law). EvidenceB’s policy on the protection of personal data allows the personal data of users of the Site to be collected and used in a transparent, confidential and secure manner. The Personal Data Protection Policy is an integral part of the General Conditions of Use of the Site (see §3 above). 8. Applicable law and attribution of jurisdiction
In accordance with Article 17 of Law No. 2004-575 of June 21, 2004 on confidence in the digital economy (LCEN), the Site is subject to French law, as are these T&Cs. Any difficulties relating to the validity, application or interpretation of the T&Cs will be submitted, in the absence of an amicable agreement, to the Judicial Court of Paris (France), to which the Parties attribute exclusive territorial jurisdiction, regardless of the place of performance or the domicile of the defendant.
